LUCEBRA COPYRIGHT AND TRADEMARK POLICY
1. Introduction

In compliance with the Digital Millennium Copyright Act (“DMCA”), Lucebra Limited "we," "us," or "our") has established the following policy regarding copyright infringement. We reserve the right to:

  1. Block access to or remove material that we believe, in good faith, to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, content providers, members, or users.
  2. Terminate service to repeat offenders.
2. Reporting Copyright Infringements

If you believe that material or content accessible through our Service infringes your copyright (or the copyright of someone you are authorized to act on behalf of), please send a notice of copyright infringement containing the following information to Lucebra's Designated Agent (contact details below):

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, including information sufficient to locate the infringing material.
  • Contact information for the notifier, including address, telephone number, and email address.
  • A statement that the notifier has a good faith belief that the material is not authorized by the copyright owner, its agent, or the law.
  • A statement made under penalty of perjury that the information provided is accurate and the notifier is authorized to make the complaint on behalf of the copyright owner.
3. Response to Infringement Notifications

Upon receipt of a valid notice of copyright infringement, we reserve the right to:

  • Remove or disable access to the infringing material.
  • Notify the content provider accused of infringement that we have removed or disabled access to the material.
  • Terminate the content provider's access to the Service if they are a repeat offender.
4. Counter-Notice Procedure

If you believe that the material removed (or to which access was disabled) is not infringing, or you have the right to post and use such material, you may send us a counter-notice containing the following information:

  • A physical or electronic signature of the content provider.
  • Identification of the material that has been removed or disabled and the location where it appeared before removal or disabling.
  • A statement of good faith belief that the material was removed or disabled due to mistake or misidentification.
  • The content provider's name, address, telephone number, email address, and a statement consenting to the jurisdiction of the Federal Court for the judicial district where the content provider's address is located or any judicial district where Lucebra is located, and agreeing to accept service of process from the person who provided the original notification of infringement.

Upon receipt of a counter-notice, we may inform the original complaining party and may replace the removed material or cease disabling it in 10 to 14 business days, unless the copyright owner files an action seeking a court order against the content provider.

5. Trademark Infringement

Lucebra also respects the trademark rights of others. Accounts containing misleading content or violating another's trademark may be updated, suspended, disabled, or terminated at our discretion. If you believe your trademark is being used without permission on our Services, please email us at copyright@lucebra.com. We will review your submission and may remove the offending content, warn the individual, and/or temporarily or permanently suspend or disable the account.

6. Legal Advisory

We suggest consulting a legal advisor before filing a notice of infringement. Be aware that there are penalties for false claims under the DMCA.

7. Respect for Intellectual Property

Lucebra respects the intellectual property rights of our content providers, instructors, users, and other third parties, and expects users to do the same. We reserve the right to suspend, disable, or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights, trademarks, or other intellectual property rights of others.
